Adverting to your letter of the 31st May, 1932, No. 92652/32, relative to the proposed Agreement with the Government of Hong Kong which involves the surrender of the Kowloon Peak Military Reserve, I am commanded by the Army Council to state that they have been informed by the Air Council that the latter raise no objection to omission from the formal agreement of the stipulation that the portion of the area surrendered within a radius of one mile from the Aerodrome should be kept free from masts, high buildings or other structures likely to cause obstruction to flying, provided that the Hong Kong Government will definitely undertake to attach to such portion the limitations for its future use and development specified in the stipulation in question.
The General Officer Commanding the British Troops in China has therefore been authorised to complete the agreement without reference to the stipulation subject to the desired under taking being given by the Hong Kong Government.
The Army Council regret that exceptional circumstances have prevented an earlier reply to your letter.
